I'm not sure that this is the case,
http://unicode.org/faq/utf_bom.html#BOM has details and states that
UTF-8 can have a BOM but it makes no difference to the actual byte
order, but the Notepad BOM that is added to UTF-8 text files is correct.

Unless, of course, I'm reading things wrongly - which does happen a lot!
