Lawyers can twist the law in the way they want anyway, so everything
is OK ;)
Honestly, there is no problem with distributing the database engine
as long as you don't change code within the engine itself. Feel free
to create your databases and stored procedures, and let your closed
source app access it using the normal API. Be aware of that if
anybody of your clients know what Firebird is, they can easily access
all the data in the database if they have access to the database file
itself.
